Terms of Service

1. Acceptance of Terms

By accessing KalpitLabs, you agree to these Terms of Service. If you disagree, do not use our services.

2. Service Description

KalpitLabs provides synthetic data generation services using machine learning algorithms to create privacy-preserving datasets for ML training, testing, and development.

3. Account Registration

• You must provide accurate information
• You're responsible for account security
• One account per user/organization
• Minimum age: 18 years
• You must have authority to bind your organization

4. Acceptable Use

You agree NOT to:

• Use services for illegal purposes
• Generate synthetic data to circumvent privacy regulations maliciously
• Reverse engineer or attempt to extract our algorithms
• Upload data you don't have rights to
• Overload or disrupt our systems
• Share account credentials
• Use services to harm others or spread misinformation

5. Data Ownership

• You retain ownership of uploaded source data
• You own generated synthetic data
• We retain right to aggregate anonymized usage statistics
• You grant us license to process your data to provide services

6. Intellectual Property

• KalpitLabs platform, algorithms, and models are our property
• You may not copy, modify, or redistribute our technology
• Our trademarks and branding remain our property

7. Payment Terms

• Subscription fees are billed monthly/annually
• All fees are in INR (₹)
• Payment due upon invoice
• No refunds for partial months
• We may change pricing with 30 days notice
• Account suspension for non-payment after 15 days

8. Service Availability

• We aim for 99.5% uptime but don't guarantee uninterrupted service
• Scheduled maintenance will be announced
• We're not liable for downtime beyond our control

9. API Usage

• Rate limits apply based on your plan
• Excessive usage may result in throttling
• API keys are non-transferable
• Keep API credentials secure

10. Data Accuracy

• Synthetic data is generated algorithmically
• We don't guarantee accuracy for specific use cases
• You're responsible for validating synthetic data quality
• No warranty for fitness for particular purpose

11. Liability Limitations

To maximum extent permitted by law:

• We're not liable for indirect, consequential damages
• Total liability limited to fees paid in last 3 months
• We're not liable for data loss (maintain your backups)
• No liability for third-party actions

12. Indemnification

You agree to indemnify KalpitLabs against claims arising from:

• Your use of services
• Violation of these terms
• Infringement of third-party rights
• Your uploaded data

13. Termination

• Either party may terminate with 30 days notice
• We may suspend/terminate immediately for terms violations
• Upon termination: access ends, data deleted per retention policy
• Outstanding fees remain due

14. Compliance

• You must comply with applicable data protection laws (GDPR, DPDPA, etc.)
• You're responsible for obtaining necessary consents for uploaded data
• You must use synthetic data in compliance with regulations

15. Modifications

• We may modify terms with 30 days notice
• Continued use constitutes acceptance
• Material changes will be highlighted

16. Governing Law

These terms are governed by Indian law. Disputes resolved in courts of India.

17. Dispute Resolution

• First attempt good-faith negotiation
• Then mediation
• Then arbitration under Indian Arbitration Act
• Class action waiver

18. Severability

If any provision is unenforceable, remaining terms continue in effect.

19. Entire Agreement

These terms constitute the entire agreement between parties.
